Premises without Halal Certification may be fined RM5 million

Kuala Lumpur: Food business premise without Halal Certification, but uses the term Ramadan buffet to promote the sale, could be charged under the Trade Descriptions Act.

Under the Trade Descriptions Act, the Trade Descriptions (Definition of Halal) Order 2011, the business owner is convicted of an offense may be fined up to RM5 million for a body corporate and a maximum fine of RM1 million for individuals.

Offenders may also be found guilty under the Halal Certification and Marking of the same Act, the maximum fine of RM200, 000 for a body corporate, and a maximum fine of RM100, 000 for individuals.

JAKIM monitored more frequently 

Halal Hub Division Director, Department of Islamic Development Malaysia (JAKIM), Hakimah Mohd Yusoff said, the company will make more frequent and detailed monitoring to ensure that all parties comply with the law.

He said although the monitoring carried out at the premises of a halal certificate, enforcement based on complaints can be taken on any premises in violation of the act.

"Jakim appointed as Assistant Controller in accordance with the Trade Descriptions Act and may take action on any person who violates this act," he told BH when called yesterday.

He was asked to comment on the use of the term Ramadan buffet is used indiscriminately to confuse the Muslims who want to break their fast at the business premises.

Yesterday, Jakim Director-General Datuk Othman Mustapha, asking for food premises operators and hotels have halal certificate from JAKIM or State Islamic Religious Department (JAIN) before promoting Ramadan delicacies.

Suspension of Halal Certification 

Last year, eight premises got their Halal Certificate suspension action and action by the act, while the seven premises warned.

In addition, Hakimah said, with the increasing consumer awareness and the frequency of people that refer to Jakim regarding halal status of the premises on which such promotional offers.
